Residence Permit Is Not a “Single-Type” Permit
The Law No. 6458 on Foreigners and International Protection, which regulates the legal-stay status of foreigners in Türkiye, defines the residence permit in six separate categories. Each type is constructed for a specific purpose and a specific person profile. For this reason “residence permit” is a generic concept; in reality the permit you will receive is one of those six types, depending on your situation.
It is not only the names that distinguish the types from each other. Each has a different application process, required conditions, maximum duration that can be granted, rights provided (especially in terms of the right to work) and effect on transitions to other permits. Time spent under one type may not count toward another permit type; this is a critical point for long-term plans.
Six Main Types
Below we summarise the general framework of each type. The aim of this list is not to be a comprehensive guide but to give a view of the main outlines — each type has its own sub-categories and conditions that differ.
Short-Term Residence Permit
This is the broadest category. Stays for tourism purposes, foreigners acquiring real estate in Türkiye, those establishing commercial connections, those coming for treatment purposes, those present for academic purposes and similar situations are evaluated under this category. The short-term residence is the most frequently applied-for type but also the most expensive when chosen wrongly — because it forms only a limited bridge to transitions to other types.
Family Residence Permit
This is the category defined for those married to a Turkish citizen, or for the spouse and children of a foreigner legally residing in Türkiye. It runs through the sponsor (the supporting person). Our detailed article addresses the family residence permit for those considering it under a separate heading.
Student Residence Permit
This is for foreigners receiving education at higher-education institutions in Türkiye. The duration of education and the status of the institution determine the conditions of the permit. Transition to another type after education requires a separate evaluation.
Long-Term Residence Permit
This is the status defined for foreigners who have resided in Türkiye uninterruptedly for a long time and who meet certain conditions. The advantage of this type is relative continuity — renewal intervals are much wider than other categories. However, the conditions for transition to this status are strict and require special evaluation per file.
Humanitarian Residence Permit
This is for foreigners in special situations who do not fit the standard categories but whose stay in Türkiye is deemed appropriate. It is granted at the discretion of the Ministry. It is an exceptional category spreading across a wide area.
Victim of Human Trafficking Residence Permit
This is a permit type granted under very special conditions for protection purposes. It is not a general application category; it runs upon the determination of the relevant institutions.
”Which Type Should I Choose?” — Wrong Direction
This is the question we hear most often in consultancy meetings. The answer surprises most people: the applicant does not have the right to “choose” the type. The permit type is determined as the one type suitable for the applicant’s life conditions, purpose in Türkiye and current documents, or as a very limited number of options.
That is, the correct question is not “which one do I want?” but “which one is possible for me?”. Missing this distinction leads to taking the wrong path at the very beginning of the application — and once this path is opened, going back later is often not possible or is very costly.
The permit type is not chosen, the suitable one is identified. This identification should be made before the first application.
The Cost of Choosing the Wrong Type
In the residence permit files we have handled for 22 years, we have frequently seen losses caused by wrong type choice. Below are three typical scenarios, anonymised:
Profile A — Property Owner, Applied from the Wrong Category
A foreigner who purchased real estate in Türkiye applied for a residence permit via another category just because it was “the most common”. Yet property ownership is itself a sub-category that provides certain advantages. The result: the file is processed, the permit is obtained, but none of the conveniences brought by being a property owner can be used. The advantage lost on the first application cannot be regained on subsequent renewals.
Profile B — Has a Turkish Spouse, but Did Not Apply from Family Residence
A foreigner married to a Turkish citizen applied from short-term residence for the sake of speed. The long-term advantages of the family residence permit, the counting of the period on the path to citizenship and similar points were missed. After a few years had passed, the question “why didn’t I apply from that path?” comes onto the agenda — but the period that could have been gained from that path can no longer be recovered.
Profile C — Wants to Start Working, but the Permit Does Not Allow It
A foreigner who obtained a residence permit in Türkiye later found a job or wanted to start working. However, the permit type they had obtained is in a category that does not grant the right to work. To start working, it is necessary either to obtain a separate work permit or to transition to a different permit type — and this transition is not always a straight road.
Important The type of residence permit does not only mean “legal stay in Türkiye”. At the same time the right to work, whether the period is counted on the path to citizenship, the situation of family members and the flexibility of transition to other permits — all are determined by the type.
Is Transition Between Types Possible?
It is possible; but it is not automatic. While under one type, transitioning to a different type does not happen with a single operation that says “change the permit type”. Every transition means a new application, a new evaluation and a new file. While some transitions are relatively easy, in others setups arise that may even require temporarily leaving Türkiye.
There are three fundamental factors that determine the ease of transition:
- The validity status and duration of your current type
- How well you meet the conditions of the type you want to transition to
- Whether there are record issues in your previous permits (delay, violation, rejection)
The combination of these three factors determines whether the transition is feasible or whether one must start from the beginning.
Renewal vs. Reapplication
These two concepts are frequently confused. Renewal means extending the period under the same type; the process is relatively simple and runs over the continuity of the previous file. Reapplication, however — especially when a type change is involved — means opening a new file from scratch.
Many foreigners, when they do not act before their permit period expires, lose the right of renewal with the expiry of the period and have to make a reapplication. This temporal sensitivity is the most overlooked dimension of residence permit planning.
Before You Start
The residence permit is the foundation of all legal life in Türkiye. Being able to rent a home, opening a bank account, enrolling a child in school, benefiting from health services — all depend on a valid residence permit. For this reason, a mistake made on this file does not only affect the file but also directly affects the daily flow of life.
At JS Vural Danışmanlık, since 2003 we have been handling immigration processes solely for foreigners. Residence permit files are the backbone of our services — because most processes (work permit, citizenship, family reunification) rise on a correctly built residence permit foundation:
- Individual document follow-up and process management in more than 6,500 files in 22 years
- Support in 4 languages — Turkish, Russian, English and German
- Before the first application, type suitability analysis — determining the single type suitable for your situation or the most advantageous among the available options
- At turning points such as renewal, type change and transition to other permits, file management
- Through relevant institutions starting with the Migration Administration in Türkiye, years-built communication infrastructure
What sets us apart is this: we handle every file personally. Our client number is particularly kept limited; in this way for every applicant not only “which type is suitable” but also “which type is most suitable for your long-term plan” is evaluated. Where you stand in the process, what document is awaiting at which stage — these are always known.
The type chosen on the first application determines the direction of the years that follow. For this reason, the first step is the step that should be taken carefully.
